What's the difference between a DVRO and a civil harassment order?+

A Domestic Violence Restraining Order (DVRO) applies when the restrained person is a spouse, former spouse, co-parent, dating partner, or close relative — someone you have a domestic relationship with. A Civil Harassment Restraining Order covers everyone else — neighbors, coworkers, roommates, or strangers. The forms and legal standards differ. We prepare both types at your direction.

How long does a restraining order last in California?+

Temporary restraining orders typically last 21-25 days until the court hearing. After the hearing, a permanent restraining order can be issued for up to 5 years. It can be renewed before expiration. We prepare the initial petition and can also prepare renewal documents at your direction.

Can I get a fee waiver for the court filing fees?+

Yes. If you cannot afford court filing fees, you can request a fee waiver (Form FW-001). Eligibility is based on income and public benefits. We can prepare the fee waiver form alongside your petition at your direction. Many restraining order petitioners qualify for fee waivers.

What if the restrained person violates the order?+

If a restraining order is violated, contact law enforcement immediately. A violation of a valid restraining order can result in criminal charges. Keep a copy of the order with you at all times and document any violations (dates, times, what happened) to report to police and the court.
